DISCLAIMERS:

General Disclaimer
Dylan & Inns (“we” or “our firm”) prepares seller disclosure statements and related services in line with the Property Law Act 2023 (Qld). We do our best to make sure everything is accurate and compliant, but the information we provide should not be taken as a replacement for getting your own independent legal, financial, or professional advice.

Legal Advice Disclaimer
Some of our services may involve legal information prepared under the supervision of a qualified Solicitor with a current practising certificate. However, unless you’ve signed a separate agreement with us, this doesn’t create a formal solicitor-client relationship beyond the disclosure services we provide.

Third-Party Search Disclaimer
We rely on outside providers (like councils, state authorities, and title offices) for property searches. Because of this, we can’t guarantee the accuracy or timing of their information and we aren’t responsible for any delays or mistakes that come from those sources.

No Guarantee of Sale or Transaction Outcome
Our disclosure services don’t guarantee that your property will sell, that a buyer will approve the purchase, or that everything will stay compliant after the statement is completed. Laws can change and new information may come up that could affect the document’s accuracy or relevance.

Limitation of Liability
To the fullest extent allowed by law:

  1. Liability Cap
Our total liability to you (whether in contract, negligence, or otherwise) is limited to the fees you paid us for the service.

  2. No Consequential Loss
We aren’t responsible for indirect or flow-on losses like missed opportunities, lost revenue, lost data, or lost profits linked to our services or documents.

  3. Client Responsibility
You’re responsible for making sure the information you give us is accurate and complete. We aren’t liable for errors or omissions that come from incorrect or incomplete instructions.

  4. Reliance on Third Parties
We aren’t responsible for errors or delays in information from government searches, external reports, or other third-party databases.

  5. Australian Consumer Law
Nothing here limits your rights under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law. Where the law allows, our responsibility is limited to either re-supplying the service or refunding the service fee.
